4)   Child Support

a)        Child support payments must be in accordance with the Federal Child Support Guidelines and is available at http://canada.justice.gc.ca/en/ps/sup/grl/glp.html  

 

5) Divorce order information

Following an application for ontario divorce simple, or ontario divorce joint, a divorce order may be granted upon approval by the honourable justice and upon the following conditions and or any other condition(s) as set by the honourable justice:

6) Ontario divorce joint

a)       The parties will completely co-operate in their joint divorce action and sign all the necessary forms;

b)      The only claim made is a divorce only. There are no other claims whatsoever in relation to assets, division of property, support, custody or access to the child(ren);

c)       If there are children of marriage, child support must be paid according the Federal Child Support Guidelines available at: http://canada.justice.gc.ca/en/ps/sup/grl/glp.html;

i.             The parties have received or attempted to receive marriage counseling to save their marriage;

ii.           The parties have received guidance from a marriage guidance facility in-order to save their marriage;

iii.         All attempts to reconcile have failed and that there is no possibility of reconciliation;

iv.         One of the spouses has lived in Ontario for at least one year prior to commencing this divorce action;

v.           The parties have lived separate and apart from each other for one year;

vi.         The divorce may be denied for a reason that is contrary to the Divorce Act or the Family Court Rules.

 

7)    Ontario divorce simple

i.              The only claim made is a divorce only. There are no other claims whatsoever in relation to assets, division of property, support, custody or access to the child(ren);

ii.           If there are children of marriage, child support must be paid according to the Federal Child Support Guidelines available at: http://canada.justice.gc.ca/en/ps/sup/grl/glp.html ;

iii.         You the applicant, have received or attempted to receive marriage counseling to save your marriage;

iv.         You the applicant, have received guidance from a marriage guidance facility in-order to save your marriage;

v.           All attempts to reconcile have failed and that there is no possibility of reconciliation;

vi.         You OR your spouse have lived in Ontario for at least one year prior to commencing this divorce action;

vii.       You have lived separate and apart from your spouse for at least one year.

viii.     If adultery has been committed by the respondent spouse, the respondent spouse has admitted to adultery and that they are willing to give written evidence;

ix.          If cruelty (physical or mental) has been committed by the respondent spouse, the applicant, has evidence to prove cruelty. Such evidence can be doctor's report, police report, etc.

x.            The respondent spouse must be served within 180 days of filing your divorce application at the court;

xi.          The respondent spouse has not contested the divorce;

xii.         The applicant spouse has not delayed providing or returning the requested information, evidence, forms and any other documents in relation to their claim for divorce;

xiii.       The divorce may be rejected or denied for a reason that is contrary to the Divorce Act or the Family Court Rules.

xiv.       All divorce actions must be finalized within 230 days from the date it was filed.

 

8)      Application Divorce Simple Process

a)       The process of application divorce simple by quickforms.ca, includes, delivery (service) of the application divorce and all other documents to the respondent spouse by way of regular mail only.

b)       Additional charges apply, If the respondent spouse refuses to co-operate. These charges may include and are not limited to personal service, or motions to validate service, or substitute service.

c)       If the divorce is contested, quickforms.ca, will forward your file to a lawyer of your choice. quickforms.ca, will refund any unused purchase price according to our refund policy at paragraph 14.

d)       Six weeks divorce process must NOT be contested and is subject to delay for reasons out of quickforms.ca control including but not limited to finding and serving the spouse, acts of god, strikes, fire, floods, etc.

 

9)      Separation Agreement

a)       The separation agreement template is provided by quickforms.ca, for informational purposes only.

b)       The separation agreement is not intended to be used as a guide. Legal advice must be sought for your specific legal situation.

c)       quickforms.ca, does not engaged in providing legal or other professional advice.

d)       The separation agreement template is not a substitute for the advice of a lawyer.

e)       You should seek the advice of a lawyer, if you require legal advice.

f)         quickforms.ca, does not provide and makes absolutely no guarantee, warranty, assurance, promise, contract, or any other whatsoever of any nature or kind whatsoever with respect to the separation agreement template.

 

10)      Motion to validate, or substitute or dispense with service

a)       Validate service- If the application for ontario divorce simple has come or may have come to the attention of the respondent spouse, you can request and purchase the necessary forms to validate service at an additional fee.

b)       Substitute service- ontario divorce action- If the respondent spouse can not be located under normal circumstances, and you have information about their immediate family member with whom the respondent spouse is in contact with, you can purchase the necessary forms to substitute service at an additional fee.

c)       Dispense service- ontario divorce action- If the respondent spouse can not be found under normal circumstances and that they have not family members in Canada and that they may have left Canada, you can purchase the necessary forms to dispense with service.

d)      quickforms.ca,a can not warrant or give any guarantees whatsoever for the outcome of any court order when any of the motions listed above have been requested. All orders are granted by the hounourable justice and we have a documented proven track record!

 

11)      Guides

a)       All guides are none refundable.

b)       Some courts may impose a slight procedural variation other than the procedural instructions given in the guide.

c)       Guides do not provide or constitute legal advice. Legal advice must be sought from a lawyer.

d)       quickforms.ca does not guarantees, or warrant any of it's guides purchased at it's web site.

 

12)      Guarantees

a)       quickforms.ca, guarantees the format of each and every form other than the information entered at the request of the purchaser on to the forms. Any changed made to the forms or any personal information entered into the forms voids this guarantee.

  

13)  Fee schedule

a)       All fees are subject to change from time to time with prior notice and available at our web site, and at the web site of the attorney general, in which event the purchaser, may choose upon such notice pay the increased rate or withdraw their file.

14)  Refunds

a)       All refunds are made according to the method of payment received. Full refund is provided subject to our guarantee at paragraph 12. Any outstanding fee will be refunded if the process of any work is withdrawn and is subject to our fee schedule at paragraph (13.d.);
